Terms and Conditions

1. Scope of Work:

JonDevJourney, represented by Ilhomjon Matjokubow, agrees to provide web development services as outlined in the project proposal. Any additional services or features requested by the client that fall outside the initial scope will be subject to separate agreement and additional charges.

2. Project Timeline:

A project timeline will be provided outlining key milestones and deadlines. Delays caused by the client (e.g., late feedback, approvals) may impact the project schedule.

3. Payment Terms:

The total project cost, payment schedule, and accepted payment methods are detailed in the project proposal. Late payments may incur additional fees.

4. Intellectual Property Rights:

Upon full payment, the client will own the intellectual property rights to the final product. JonDevJourney retains the right to showcase the project in its portfolio.

5. Client Responsibilities:

The client agrees to provide necessary information, feedback, and approvals in a timely manner. Delays caused by the client may impact the project timeline.

6. Revisions and Changes:

The project proposal includes a specified number of revisions. Additional revisions or changes may be subject to additional charges.

7. Termination Clause:

Either party may terminate the agreement under certain circumstances. Termination fees or refunds, if applicable, will be outlined in the project proposal.

8. Confidentiality:

Both parties agree to keep any confidential information exchanged during the project confidential. This obligation extends beyond the completion of the project.

9. Communication Protocols:

JonDevJourney will communicate project updates and receive feedback primarily through email (jon@jondevjourney.com), WhatsApp (+43 660 9339169) and Google Meets. The client agrees to respond within 48 hours.

10. Deliverable Approval Process:

The client will have the opportunity to review and provide feedback on deliverables. Approval or requested changes must be communicated within 24 hours.

11. Liability and Indemnity: 

JonDevJourney is not liable for any damages or losses resulting from the use or inability to use the final product. The client agrees to indemnify JonDevJourney against any claims arising from the content or functionality of the delivered project.

12. Force Majeure:

Neither party will be held liable for delays or failure to perform due to circumstances beyond their control, including but not limited to natural disasters, acts of terrorism, or government actions.

13. Dispute Resolution:

Any dispute arising out of or in connection with this agreement, including any question regarding its existence, validity, or termination, shall be subject to mediation in accordance with the rules of the Centre for Effective Dispute Resolution (CEDR). If mediation is unsuccessful, the dispute will be submitted to arbitration in accordance with the rules of the Vienna International Arbitral Centre (VIAC). The place of mediation/arbitration shall be Vienna, and the language shall be German/English.

14. Governing Law:

This agreement is governed by and construed in accordance with the laws of Austria.

15. Changes and Additional Fees:

If the client fails to adhere to the agreed-upon project deadline or if the deadline is extended due to factors attributable to the client, any requested changes to the project scope, design, or functionality may be subject to additional fees. The fees for project changes will be determined based on the complexity and extent of the requested modifications.
